If the court doesn't hear a case, it shouldn't be misconstrued as a "ruling" There is no ruling because they aren't hearing the case. There is no vote for and against hearing a case. If four justices want to hear a case, then the Supreme Court will hear it; clearly there weren't four justices that saw fit to hear the court case. Given that the court receives thousands of appeals every year, they aren't going to hear every one; perhaps another similar case is working through the pipe that is more applicable. If this MO. law had no constitutional implications, then the court should not hear it. The Supreme Court is not the arbiter of state laws, that’s the domain of state courts, unless that law is contradictory to federal law.
